A 44-year-old man was killed in an automobile wreck. The case settled for $1.2 million, which was the limit of insurance coverage available. However, there was a large workers’ compensation lien against the proceeds. Counsel filed a motion to strike the lien in order to more fully compensate the beneficiaries of the estate. At the hearing, the judge found that repayment of the lien would have left an inadequate amount to compensate the decedent’s wife and two children. Accordingly, the entire lien was stricken and this order was upheld on appeal.
