An elderly woman was admitted to an assisted living facility (ALF) with a tiny wound near her tailbone. The ALF was aware of the wound. Plaintiff alleged that the ALF failed to properly monitor and treat the wound, which progressed to a Stage III ulcer over the next several weeks. Despite the wound’s progression, the ALF kept the resident at the facility for another month where the ulcer increased in size and severity. The ALF ultimately transferred the resident to the local hospital whereupon surgery was immediately scheduled. By then, the ulcer was diagnosed as a Stage IV. The resident subsequently developed sepsis as a result of the ulcer which caused her premature and wrongful death. The case settled at mediation on a confidential basis.
