In 2012, a new trucking law was implemented entitled “Moving Ahead for Progress in the 21st Century Act” (MAP-21). This new law includes many provisions designed to help the Federal Motor Carrier Safety Administration in its mission to reduce crashes, injuries and fatalities involving tractor trailers, other large trucks and buses. The key provisions in MAP-21 designed to increase safety are based on three core principles:
- Raise the bar for entry into the industry and the ability to operate on our roads;
- Hold the motor carrier and drivers to the highest safety standards; and
- Remove the highest risk drivers, vehicles and carriers from our highways and to prevent them from operating.
Trucking companies and their lawyers are constantly thinking of new ways to minimize their liability under MAP-21 and other existing rules and regulations.
