Business Litigation

In addition to representing injured individuals in Winston-Salem, North Carolina and throughout the State, Kevin has significant experience handling business disputes.  Earlier in his career, Kevin represented both homeowners and subcontractors in the synthetic stucco construction litigation explosion that occurred all over North Carolina in the late 1990s.  Kevin has handled cases involving business torts such as fraud and misrepresentation.  He has experience interpreting contractual language to determine whether insurance provides coverage.  Further, Kevin has had success in getting past the corporate entity to hold individual company owners responsible for the acts of their company.  Often, individuals form shell corporations for the purpose of avoiding personal liability in the event of a lawsuit.  When it can be proved that these shell corporations merely act as the “alter ego” of the individual, it is possible to hold the individual accountable.  This is known as “piercing the corporate veil.”  Kevin has held individuals responsible for the acts of their companies through the use of aggressive discovery, thorough deposition techniques and the help of forensic accountants.  Kevin handles cases involving, but not limited to:

  • Fraud litigation
  • Breach of contract
  • Unfair and deceptive trade practices
  • Employment agreement disputes
  • Non-compete agreements
  • Corporate risk management and stockholder litigation
  • Fair Labor Standards Act and other employment litigation cases
  • Whistleblower lawsuits
  • Professional responsibility litigation
  • Construction litigation

Kevin does not simply “manage” litigation.  He is thoroughly trained to try cases.  Most cases do not go to trial.  The only way to maximize a settlement for either side is for the client and the lawyer to work together from the start under the expectation that the case will go to trial.
